Platform description
SMIPA CC connects hospitality venues with content creators for gifted and paid partnership campaigns. SMIPA provides the platform only — we are not a party to agreements between venues and creators.
User responsibilities
Venues must post accurate briefs, respond to applications in good faith, honour agreed compensation, and complete campaigns on the platform.
Creators must provide accurate profile information, deliver agreed content, disclose partnerships in line with ASA rules, and submit content links via SMIPA CC.
Content ownership
Creators retain ownership of their content. By participating in a campaign, creators grant the venue a licence to use the agreed deliverables for the purposes of that campaign, as specified in the brief and partnership confirmation.
ASA disclosure requirements
All sponsored or gifted content must be clearly labelled as an advertisement. Creators must use "Ad", "#ad", or equivalent disclosure visible to the audience, in line with UK Advertising Standards Authority guidance.
Prohibited conduct
- False or misleading profile or brief information
- Harassment, discrimination, or abusive behaviour
- Circumventing the platform to avoid fees or accountability
- Spam, fraud, or illegal activity
SMIPA's role
SMIPA is a technology platform facilitating introductions and workflow. We do not guarantee campaign outcomes, content quality, or user conduct. Disputes between venues and creators should be resolved directly between parties.
Liability limitations
To the fullest extent permitted by law, SMIPA Digital Marketing Ltd is not liable for indirect, incidental, or consequential losses arising from use of the platform. Our total liability is limited to fees paid to SMIPA in the twelve months preceding the claim, if any.
Governing law
These terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction.
