Platform description
SMIPA Creator Community connects hospitality venues with content creators for gifted and paid partnership campaigns. SMIPA provides the platform only. We are not a party to agreements between venues and creators.
User responsibilities
Venues must post accurate briefs, respond to applications in good faith, honour agreed compensation, and complete campaigns on the platform.
Creators must provide accurate profile information, deliver agreed content, disclose partnerships in line with ASA rules, and submit content links via SMIPA Creator Community.
Visual creators (photographers and videographers) must keep their packages, availability and any insurance details accurate, honour confirmed bookings, and deliver the agreed files within the time stated in the booking.
Content ownership
Creators retain ownership of their content. By participating in a campaign, creators grant the venue a licence to use the agreed deliverables for the purposes of that campaign, as specified in the brief and partnership confirmation.
ASA disclosure requirements
All sponsored or gifted content must be clearly labelled as an advertisement. Creators must use "Ad", "#ad", or equivalent disclosure visible to the audience, in line with UK Advertising Standards Authority guidance.
Prohibited conduct
- False or misleading profile or brief information
- Harassment, discrimination, or abusive behaviour
- Circumventing the platform to avoid fees or accountability
- Spam, fraud, or illegal activity
SMIPA's role
SMIPA is a technology platform facilitating introductions and workflow. We do not guarantee campaign outcomes, content quality, or user conduct. Disputes between venues and creators should be resolved directly between parties.
Liability limitations
To the fullest extent permitted by law, SMIPA Digital Marketing Ltd is not liable for indirect, incidental, or consequential losses arising from use of the platform. Our total liability is limited to fees paid to SMIPA in the twelve months preceding the claim, if any.
Instagram integration
Connecting Instagram is optional. If you choose to connect your Instagram professional account using Instagram Login, you authorise SMIPA Creator Community to access Instagram API data as explained in our Privacy Policy. You must only connect Instagram accounts you are authorised to manage.
By connecting Instagram, you acknowledge that SMIPA Creator Community may use your Instagram API data for the following purposes only:
- Profile quality and verification: your Instagram follower count, engagement rate, and audience data may be displayed on your creator profile to help venues evaluate your fit for campaigns
- Creator-venue matching: Instagram audience geography, age, and engagement data may be used to generate matching recommendations. These are suggestions only: venues make all final decisions
- Track & Measure campaign reporting: where you participate in a campaign, Instagram API media and account insights may be used to populate campaign performance reports. SMIPA does not claim exact attribution of business outcomes to your content
SMIPA Creator Community does not publish content, manage messages, manage comments, run ads, access shopping or catalogue features, or take any action on your Instagram account beyond reading the data described above. Disconnecting Instagram in SMIPA Creator Community removes your Instagram profile, audience, and insights data and access token. Performance metrics already recorded for content you submitted to a completed campaign are retained as part of that campaign's record, as explained in the Privacy Policy.
TikTok integration
Connecting TikTok is optional and separate from Instagram: you may connect either, both, or neither, and disconnecting one does not affect the other. If you connect your TikTok account using TikTok Login Kit, you authorise SMIPA Creator Community to access TikTok Display API data as explained in our Privacy Policy. You must only connect a TikTok account you are authorised to manage.
By connecting TikTok, you acknowledge that SMIPA Creator Community may use your TikTok data for the following purposes only:
- Profile quality: your TikTok follower count and per-video statistics may be displayed on your creator profile to help venues evaluate your fit for campaigns
- Creator-venue matching: your follower count and video engagement may be used to generate matching recommendations. These are suggestions only: venues make all final decisions
- Track & Measure campaign reporting: where you submit a TikTok video to a campaign, the statistics TikTok reports for that video may be used in the performance report given to the venue
TikTok's API does not report reach, impressions, saves or audience demographics, so we hold none of those for TikTok and they are shown as not reported rather than as zero. SMIPA Creator Community does not publish content, manage messages or comments, run ads, or take any action on your TikTok account beyond reading the data described above. Disconnecting TikTok asks TikTok to revoke our access and removes the tokens and video statistics we hold. Performance figures already recorded for a video you submitted to a completed campaign are retained as part of that campaign's record, as explained in the Privacy Policy.
Suspension and account closure
You may close your account at any time from Settings. We may suspend or close an account that breaches these terms, in particular for the prohibited conduct listed above. Where we do so we will tell you why, unless we are legally prevented from doing so.
Closing an account erases your personal data immediately. Where you have completed campaigns, the record of those campaigns is kept in anonymised form so the other party keeps their own history: this applies equally to venues and creators, so neither side can erase the other's record of work completed and paid for. This is set out in full in the Privacy Policy.
Changes to these terms
We may update these terms to reflect changes to the platform or to our legal obligations. We will notify registered users of material changes by email at least 14 days before they take effect. The date at the top of this page shows when these terms were last updated.
Governing law
These terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction.
